Insurance Coverage

 

Tara Trask developed a juror profile in a high profile insurance coverage case.  Using data gleaned from multiple pre-trial research projects and a 400 person community attitude survey, she developed an Ideal/Non-Ideal profile of the jurors sought in that case.  Furthermore, the research allowed Ms. Trask and the trial team to draft a Supplemental Juror Questionnaire with questions designed to identify unfavorable jurors without alerting the opposing side.  In an 11 to 1 decision, jurors found for Ms. Trask’s corporate client and the $250 million verdict was one of the largest in the state that year.

 

Insurance Bad Faith

 

An individual brought a coverage/bad faith claim against an International insurer.  The trial team conducted a one day focus group, with a modest plaintiff result.  New theories of the case were developed and were re-tested in a mock trial.  Graphics team Point Multimedia was engaged and Greg Glass and Tara Trask along with trial counsel developed juror friendly graphics for use in teaching the difficult insurance concepts at trial.  Ms. Trask was involved in every aspect of the case from the early pre-trial research to the graphics to Opening statement and closing argument.  Ms. Trask was present offering feedback for the trial team every day of trial.  Tara Trask and Associates also facilitated a shadow jury whose combined findings on liability were in line with the actual jury.  The shadow jury was also within two hundred thousand dollars of the actual jurors’ eventual $7.3 million dollar verdict.

 

Intellectual Property

 

A food manufacturing company was suing another over a patent involving a process to make a food product and the corresponding machinery.  Tara Trask and Associates assisted the trial team with case themes, graphics consultation and witness preparedness.  Ms. Trask assisted with jury selection and attended trial every day offering strategic advice.  The jury awarded the client $26 million.

 

Securities

 

In a complex securities case a nationally known defendant was awaiting a verdict.  The client, understandably nervous with the jury out, was contemplating re-engaging in settlement negotiations, and making a multi-million offer that would settle the case.  Ms. Trask recognized the skittishness, and leaning on her significant trial experience in similar arenas urged her client not to make the eight figure offer.  The client agreed, and within two hours the jury came back with a full defense verdict.

 

Product Liability

 

Tara Trask and Associates defended three internationally known medical device manufacturers in a product liability and failure to warn case.   The plaintiff was represented by well know plaintiffs’ counsel and assisted by a nationally known plaintiff’s attorney and jury consultant.  After navigating two mistrials and lengthy voir dire process that included questioning over 300 jurors, a panel was seated.  After six weeks of testimony, the jury rendered a full defense verdict.

 

Class Actions

 

Tara Trask and Associates conducted pre-trial research in a case involving over charging of users of a state owned service.  Representing the class, Ms. Trask presented some of the pre-trial research at the mediation.  The data allowed both sides to take the guesswork out of “what a jury might do” and instead provided a projection of how jurors might problem solve the dispute.  After a 14 hour mediation process, the case was settled for eight figures.
